  • You must have lived in the county that you are filing in for at least three months prior to filing


If during the six months before filing, you lived in two different counties for three months each, then you can file in either county.


After filing, California has a mandatory six month cooling off period. This is set up to give couples a chance to stop the divorce, should they reconcile.
