Culver City Child Support Lawyer

Establish & Modify Your Child Support Agreement

Need a lawyer for your child support case in Culver City or Santa Monica? Going through divorce can be a very emotionally difficult process. If you are not awarded the custody, assets, or support that you were hoping for, then you may be able to obtain a modification to your current circumstances. Child support may be one such issue that requires a modification under family law. These payments are determined based on:

  • Your net income
  • The number of children
  • Your percentage of custody
  • Your ex-spouse's net income

The payments are designed to supplement your ex-spouse's income so that he / she are able to provide financially for the children in their custody. As a parent, married or unmarried, you have the responsibility to financially provide and care for your child's needs until they reach the age of emancipation (which is typically 18) when they are able to financially provide for themselves.

Searching for a lawyer for a child support case in Culver City?

As time goes on, circumstances change, needs change, and disposable income changes.

  • If you are having difficulty making the required payments, then you may be able to have these payments modified to better suit your budget.
  • In order to have a reduction for support approved, you will have to be able to prove to the court that you have endured a serious change in circumstances such as a change in employment status.
  • In addition, if you are the custodial parent and the current financial supplement that you are receiving is not enough to cover various expenses, then you may be able to file a petition to have the payments modified to better provide for your needs as well.

How Is Child Support Determined in California?

The child support guidelines in California are based on the Agnos Minimum Child Support Standards Act. This legislature set the minimum guidelines for the state when determining how much support is to be paid to a parent. When calculating up the amount of child support, the court must first look at the total monthly incomes of both parents. Once the combined net incomes are established, the judge will be able to compute the percentage of income that is earned from the non-custodial parent.

The court can then take this number and multiply it by how many children are in the household- this can give the minimum level of child support. This guideline is based on a complex mathematical formula, any support that is lower than the guideline will have to be determined using computer software. Other factors can also play in child support cases, such as the special needs of a child. The court does have the right to use their discretion and waive the guidelines in special family cases.

It is important to remember that court ordered child support payments are not optional and they cannot be withheld if there is a dispute over custody and visitation. If a parent fails to make their support payments, there could be legal consequences.
